ARTICLE 1. PURPOSE

The purpose of this shipping policy is to set out the terms applicable to the shipping, delivery and, where applicable, refund of Products ordered by the Customer on the Site published by the Publisher.

In particular, it specifies how orders are processed, delivery times and methods, and the respective responsibilities of the parties.

Any natural or legal person, under private or public law, purchasing a Product on the Site, hereinafter “the Customer”.

ARTICLE 3. DEFINITIONS

“Customer”: any natural or legal person purchasing a Product on the Site.

“Site Content”: all elements published on the Site, whether or not protected by intellectual property rights, including texts, images, photographs, graphics, logos, videos, databases, software and the structure of the Site.

“Publisher”: SARL SAGO, acting as publisher of the Site.

“Internet User”: any person accessing or browsing the Site, whether or not a Customer.

“Product”: any item offered for sale on the Site by the Publisher.

“Site”: the website available at k-apsule.com, together with all its pages, subdomains and any versions.

ARTICLE 4. SCOPE

The Site is accessible free of charge to any Internet User with Internet access. All costs related to accessing the Site (hardware, software, Internet connection, etc.) are borne by the Internet User.

Browsing the Site implies full knowledge and acceptance of this shipping policy.

When placing an order on the Site, the Customer confirms this acceptance by ticking the box provided for this purpose. This confirmation constitutes unreserved acceptance of this shipping policy.

The Customer acknowledges that electronic confirmation of this acceptance has the same legal value as a handwritten signature.

This shipping policy applies to the exclusion of any other terms, unless expressly provided otherwise.

The Customer declares that they have the legal capacity to enter into a contract or, where applicable, act with the authorization of their legal representative.

ARTICLE 5. SHIPPING

5.1 Shipping schedule

Orders confirmed on the Site before 2:00 pm (Paris time) are, wherever possible, prepared and shipped the same day, on working days only.

Orders placed after this time are shipped no later than the next working day.

At certain times of the year, particularly during the summer or after the end-of-year holidays, the shipping service may be temporarily suspended for a period ranging from a few days to two weeks.

In this case, Internet Users are informed by a message on the Site indicating the date shipping will resume.

ARTICLE 6. DELIVERY

6.1 Delivery costs

The delivery costs applicable to the order are shown to the Customer before the order is finally confirmed and before any payment.

These costs apply to deliveries in mainland France, including Corsica, and in certain euro-zone countries listed on the Site.

For delivery to any other destination, the Customer is invited to contact customer service for a specific quote.

Delivery costs shown on the Site are expressed in euros including all taxes.

6.2 Delivery times

Orders are shipped via the following carriers:

France:

• Pick-up point delivery via Mondial Relay: indicative time of 3 to 5 working days

• Home delivery via La Poste – Colissimo service: indicative time of 2 to 3 working days

Belgium and Luxembourg:

• Delivery via Mondial Relay

• home delivery: 3 to 4 working days

• pick-up point: 4 to 5 working days

These times are given for information only and correspond to the average times observed.
The Publisher cannot be held responsible for delays attributable to the carrier.

In accordance with Article L.216-1 of the French Consumer Code, delivery takes place no later than 30 days after the order, unless otherwise indicated to the Customer before the order is confirmed.

6.3. Damaged parcel

If a parcel is received visibly damaged, the Customer is invited to:

• refuse the parcel from the carrier or note precise, reasoned reservations on the delivery slip;

• inform the Publisher as soon as possible via customer service.

After checking and, where applicable, receiving the returned parcel, the Publisher will send a new Product or refund the order, depending on the Customer's choice and the Product's availability.

6.4. Retention of title - transfer of risk

Products remain the property of the Publisher until the Customer has paid the price in full.

In accordance with Article L.216-4 of the French Consumer Code, the risk of loss or damage to the Products transfers when the Customer, or a third party designated by them, takes physical possession of the Products.

ARTICLE 7. FINAL PROVISIONS

7.1. Applicable law

This shipping policy is governed by French law.

7.2 Changes to the shipping policy

The Publisher reserves the right to change this shipping policy at any time.
The policy applicable to the Customer is the one in force when the order is confirmed on the Site.
Any later change will not apply to orders already confirmed.

7.3 Disputes and mediation

In the event of a dispute relating to the performance or interpretation of this shipping policy, the parties will seek an amicable solution.

In accordance with Articles L.611-1 et seq. of the French Consumer Code, consumer Customers may use a consumer mediator free of charge to resolve a dispute with the Publisher amicably.

Failing an amicable agreement, the dispute may be brought before the competent French courts, in accordance with ordinary law.

7.4 Partial invalidity

If any clause of this shipping policy is declared void or unenforceable by a court decision, the other clauses will remain fully applicable.

7.5. No waiver

The Publisher's failure to exercise the rights granted to it herein shall in no way be interpreted as a waiver of those rights.

7.6 Telephone canvassing

7.7 Language

This shipping policy is written in French. If it is translated into one or more languages, only the French version shall prevail in the event of a dispute.

7.8 Unfair terms

This shipping policy applies in compliance with the mandatory provisions of the French Consumer Code on unfair terms in contracts between professionals and consumers.
